The highest approved bidder will be the buyer subject to:\u003Cbr \/\u003E\r\nThe reserve price; and\u003Cbr \/\u003E\r\nThe sellers approval\u003Cbr \/\u003E\r\n5. Immediately on the fall of the hammer, the bidder of the highest bid accepted must sign, as buyer, the Contract of Sale in the form displayed or circulated with these conditions of sale and pay the deposit to the nominated stakeholder.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n12. The deposit payable under the contract of sale is 10% of the successful bid or any other percentage or figure nominated in the Contract of Sale.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n13. The seller and the buyer agree to sign all documents and do everything else necessary to transfer the property to the buyer. The seller and the buyer each appoint the auctioneer their agent to sign the Contract of Sale on their behalf. This appointment is non-revocable.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n14. If the buyer does not pay the deposit, at the sellers option;\u003Cbr \/\u003E\r\nThe result of the auction will be treated as invalid and the property may be resubmitted to public auction at the risk and expense of that buyer; or\u003Cbr \/\u003E\r\nThe seller may affirm the Contract for Sale and pursue their legal and other remedies against the buyer as they see fit.\u003Cbr \/\u003E\r\nAll bidders shall be deemed to have read and acknowledged the \u0026ldquo;Contract Warning\u0026rdquo; and the \u0026ldquo;Disclosure Statement\u0026rdquo; under the Body Corporate and Community Management Act 1997 which are annexed to the Contract of Sale by virtue of the fact that they have been on display prior to this auction.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nCash unconditional basis, not subject to a cooling off period, finance, or building and pest inspection. No bidder shall advance a less sum or percentage at any bidding than the Auctioneer is willing to accept.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nA bid shall be deemed to be accepted unless the Auctioneer forthwith after it has been made declares his non-acceptance or dissent.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nIf any dispute or difference shall arise as to the highest bidder the Auctioneer may reopen the bidding and resubmit the property commencing with the highest amount previously bid for the same or he may decide on the highest bidder in such other manner as he in his absolute discretion shall deem fit and his decision shall be final.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nImmediately upon the fall of the hammer the bidder of the highest bid accepted shall sign these conditions of sale and purchase and forthwith pay the deposit required and shall thereupon be deemed to be the Buyer, otherwise the property may be resubmitted at his or her risk and expense or submitted afresh to Public Auction as if the property had never before been submitted.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nThe right to bid by or on behalf of the Seller is expressly reserved.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nThe Seller and the Buyer agree to do all necessary acts and to sign all documents and papers for the purpose of transferring the property to the Buyer.
